Developer Fees / School Impact Fees

Welcome to the Oak Grove School District's Developer Fees webpage. Developer Fees (also known as School Impact Fees) are state-authorized fees collected on certain new construction and development projects to help school districts accommodate student enrollment generated by growth. This page provides information about Developer Fees, including current fee rates, payment procedures, exemptions, refunds, and other related resources.

When applying for a building permit through the City of San José or the County of Santa Clara, the permitting agency will verify the square footage of your proposed project and issue either a School District Referral Form or a Development Impact Fee Compliance Form, as applicable. Before a building permit can be issued, proof of payment to all affected school districts is required.

Developer Fee payments are accepted Monday through Friday, from 9:00 am to 3:00 PM, excluding District holidays. Please note that the District Office is also closed on Fridays in June and July as part of the District's Summer Compressed Work Schedule.

What Are Developer Fees?

New construction and development can increase student enrollment, creating a need for additional school facilities and infrastructure. To help address this growth, Government Code Section 65995 and California Education Code Section 17620 authorize school districts to collect Developer Fees on certain new residential, commercial, and industrial construction projects within their boundaries.

Developer Fee revenue is used to help fund the acquisition, construction, reconstruction, and modernization of school facilities needed to accommodate student enrollment generated by new development, as permitted by California law.

Fee Structure and Payment

Fee Structure

California law authorizes three levels of Developer Fees. The Oak Grove School District currently assesses Level I Developer Fees, the base fee level established by the State.

Please note: Developer Fee rates are established by the Board of Trustees and are subject to change in accordance with applicable law and Board action.

Payment Process

The Oak Grove School District accepts the following forms of payment:

Cashier's check
Business check
Personal check
Money order

Cash and credit card payments are not accepted.

When submitting your payment, please bring the following:

City- or County-approved project plans, as applicable.
A completed School District Referral Form or Development Impact Fee Compliance Form.
A check or money order made payable to Oak Grove School District for the required Developer Fees.

Once payment has been received, the District will complete and sign the School District Referral Form or Development Impact Fee Compliance Form. The executed form serves as verification that the required Developer Fees have been paid to the District.

Please note: A $25.00 processing fee will be charged for any returned check.

Exemptions from Developer Fees

Certain projects may be exempt from Developer Fees as provided by California Education Code Sections 17620 and 17626 and Government Code Section 65995. Even if your project qualifies for an exemption, you must still submit your School District Referral Form or Development Impact Fee Compliance Form to the District for review and approval.

Examples of projects that may qualify for an exemption include:

Residential additions of 500 square feet or less (Education Code Section 17620)
Modifications or expansions to an existing residence that improve accessibility for a person with a severe and permanent disability (Education Code Section 17620)
Reconstruction following certain natural disasters. A structure being replaced after a qualifying disaster may be exempt from Developer Fees (Education Code Section 17626)
Facilities used exclusively for religious purposes (Government Code Section 65995)
Private full-time K–12 schools (Government Code Section 65995)
Facilities owned and occupied by a federal, state, or local government agency (Government Code Section 65995)

Fees Refunds

Protesting the Imposition of Developer Fees

Pursuant to California Government Code Section 66020, a developer who believes that Developer Fees have been improperly imposed may file a written protest.

To preserve your right to protest, you must:

Pay the required Developer Fees in full, or provide satisfactory evidence that arrangements have been made to pay the fees when due, as required by law.
Submit a written notice to the Oak Grove School District that includes:
- Confirmation that the required payment has been made or that appropriate payment arrangements have been established.
- The factual basis and legal grounds for the protest.

File the protest at the time of approval or conditional approval of the development, or within 90 days of the date the fees were imposed, in accordance with Government Code Section 66020.
